About these terms
This website is run by Vivaxo, an independent web design, hosting and website care business based in North Wales. “I”, “me” and “Vivaxo” on this page mean Vivaxo. By using this website, you agree to these terms.
This page covers use of the website and gives a general summary of how I work. It does not create a contract for paid work. Any paid work is covered by a written proposal and service agreement, and if anything in that agreement differs from this page, the agreement applies.
Using this website
You may browse this website and contact me for genuine business purposes. You must not attempt to disrupt or gain unauthorised access to the site, introduce malicious code, submit unlawful or misleading material, or use the enquiry form to send spam.
Information and prices
I aim to keep the information on this website clear and up to date, but services, prices and details can change. Prices shown are a guide to the standard plans. Your exact scope and costs are confirmed in writing before any work starts. No VAT is currently charged. Vivaxo is not VAT registered.
Enquiries and proposals
Sending an enquiry does not commit you to anything. I’ll reply personally and, if I can help, send a written proposal showing the scope, costs, responsibilities and any initial term. Work starts only after you accept that proposal.
Please do not send passwords or other login details through the enquiry form. If access is needed, I’ll explain what is required and agree a safer way to share it.
How paid work is set up
In summary, and subject to your proposal and agreement: new website plans have a one-off setup fee, then a monthly fee for hosting and care that starts at launch. New website plans have a 12-month initial term, then continue monthly until either of us gives 30 days’ notice. If you leave during the initial term, any unpaid balance for that term remains due. Website Rescue care is rolling monthly from the start, with 30 days’ notice.
The setup fee for a new website covers the design and launch of the agreed pages using the business information and photographs you supply, with two consolidated rounds of changes before launch. Each plan includes a monthly allowance of time for small changes; unused time does not roll over. Larger changes, new features and repair work are quoted before they are carried out.
Domain registration and renewal, business email, premium licences, booking services, e-commerce, photography and translation are extra where needed, and are itemised in your proposal.
Your domain and your website
Your domain is registered in your name. Once the initial term of a new website plan has been paid, you can take an export of your website’s files and content without a separate buyout fee. Third-party licences, and any migration work by a new host, are separate.
Your content
You are responsible for the business information, text, logos and photographs you supply, and for making sure you have the right to use them. I’ll check that wording reads clearly, but you know your business best, so please review your pages before launch and tell me about anything that is inaccurate.
With your agreement, I may show your finished website as an example of my work, such as on this website’s Work page.
How I use AI tools
Like many developers today, I use AI-assisted tools at some points in my normal working process. For example, they can help draft a first version of code or wording, suggest alternatives, spot errors or speed up routine tasks. They are tools that support my work, in the same way as code editors, templates and spelling checkers, and they are not a replacement for it.
Every website is planned, reviewed and tested by me before it goes live. I decide what goes into your site, check that the code works and that the wording is accurate for your business, and I am responsible for the work I deliver, however it was first drafted.
I don’t put passwords, login details or your customers’ personal information into AI tools. The business information you supply for your website, such as a description of your services, may be used with these tools to help prepare drafts. I use your own photographs or properly licensed images, and I won’t present an AI-generated image as a real photograph of your business, premises, team or work.
If you would prefer AI tools not to be used on your project, let me know before work starts and we’ll agree an approach together.
Third-party services
Websites rely on services provided by others, such as hosting infrastructure, domain registrars, email providers, plugins and Google services. I choose and manage these carefully, but I can’t control their availability, pricing or policy changes. Where one affects your website, I’ll explain the options.
No guaranteed results
Website, search and marketing results depend on many factors outside my control, including competition and changes made by search engines. No particular ranking, volume of traffic or number of enquiries is guaranteed.
This website’s content
The design, text, logo and images on this website belong to Vivaxo or are used with permission. Screenshots of client websites are shown as examples of my work and remain associated with those businesses. You may not copy or reuse this website’s content for commercial purposes without permission.
Links to other websites
This website links to client websites and other third-party sites. I am not responsible for their content, availability or privacy practices.
Liability
This website is provided for general information. To the extent the law allows, I am not liable for any loss arising from reliance on its content or from it being temporarily unavailable. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, or affects your statutory rights. Separate client agreements set out the terms and limits that apply to paid services.
Privacy and cookies
How I handle personal information is explained in the privacy notice, and the cookies this website uses are explained in the cookie notice.
Changes to these terms
I may update these terms from time to time. The date at the top of this page shows when they last changed.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
